Delhi court rejected the chargesheet against Kanhaiya Kumar

6th Feb, 2019: Today Patiala House court slammed the Kejriwal govt of Delhi for not clearing the chargesheet filed by Delhi Police in the JNU treason case. Kejriwal Delhi govt is giving excuses that chargesheet was not received by the Delhi Government. While hearing of this case on Wednesday, the court slammed the Delhi government saying it could not sit on file. The court asked why the government has not approved it so far, what is the reason behind it? The government should clarify its stand on this.

19th Jan, 2019: Delhi court rejected the 1200 pages chargesheet against kanhaiya kumar because Kejriwal govt did not give the approval to file the chargesheet.

“You don’t have approval from the legal department, why did you file chargesheet without approval?” the court told the police while hearing the matter.

The Delhi police said it will get approval from the government in 10 days.

The Delhi Police filed a charge sheet against the former JNU student leader Kanhaiya Kumar for inciting anti-India slogans and inciting hatred and discontent in 2016. This charge sheet is to be heard in court on January 19. The case is of treason and Delhi’s Arvind Kejriwal government has not yet allowed the charge sheet in the case. In the case of sedition, Delhi Police has to seek permission from Delhi Government.

In such a cases, the law Department of Delhi govt. permits the police. After which this file is sent to Lieutenant Governor (LG). After which the police gets the green signal to proceed in the case. However, in this case the Delhi government has not yet given permission. In such a case, if the police did not get permission, the court will not take cognizance of the charge sheet filed against Kanhaiya kumar. On January 14, the police had extended the file itself. The case is to be heard on January 19.

According to Times of India source, the government is yet to form an opinion in the case. “We are still reading the file and no views have been formed on it,” said a senior officer on condition of anonymity. The AAP government may be in no hurry to decide, having been bypassed earlier, and will like to take its time since it’s sensitive issue. 

According to Times of India report, the prosecution sanction file was sent from the office of deputy secretary (home) to the office of principal secretary (home) on January 14. It was sent to the office of home minister Satyendar Jain on Monday morning. 

After nearly three years, the opposition parties are constantly accusing the central government of suppressing the voice of opponents, for filing a charge sheet by Delhi Police.

The police facing the allegations said that it usually takes time for such cases because in such cases the investigation is carried out across the country, under which many records and evidence have been collected. Significantly, Kanhaiya has been meeting with the opposition parties in this matter from time to time. 

Delhi Police had filed a sedition case against 9 other JNU students, including Kanhaiya, for their alleged anti-nation slogans. These accused included 7 Kashmiri people. The Delhi Police, citing statements of several witnesses in the 1200-page charge sheet, has alleged that a program was organized on 9 February 2016 in JNU campus in support of Afzal guru, mastermind of Parliament attack. According to the police, there were allegedly anti-India slogans in it.

The police have alleged that Kanhaiya was present along with the protesters at the JNU where the sloganeering was going on that day. According to witnesses, Kanhaiya was present at sloganeering place and there were terrorists Afzal posters in the hands of demonstrators.
